How a Romanian land purchase actually works

Romania transfers real estate through a civil-law notarial system: a licensed public notary — a neutral state-appointed official, not either party's lawyer — authenticates the sale deed, collects the taxes, and files the ownership change with the land registry. There is no title insurance and no escrow industry standing behind you; your protection is the land book (carte funciară), the public register recording every legally recognized property, and the diligence you do against it before signing.

That makes the buyer's process, done properly, look like this:

  • 1. Verify the land book. Obtain a fresh land registry extract: is the seller the registered owner, in what shares, and what mortgages, easements, litigation notes or sale prohibitions sit in Part III? If the land has no land book at all, stop — it must be first-registered before any notarial sale can happen.
  • 2. Verify the ground. A due diligence survey checks that the registered geometry matches reality: no overlaps with neighbours, measured area matching the deed area, the parcel actually located where the seller's fence says. Paper diligence alone misses precisely these defects.
  • 3. Pre-agreement (antecontract), carefully. Deposits are commonly secured through a notarized pre-sale agreement. Condition it on the findings and the fixes — this is the point of maximum negotiating leverage, and money paid before verification is money at risk.
  • 4. Special regimes. Extravilan agricultural land triggers the pre-emption procedure of Law 17/2014 (see the pre-emption guide); non-EU citizens face ownership restrictions (see foreign buyers guide).
  • 5. The deed and registration. The notary requests the blocking extract, authenticates the deed, and lodges the registration; you own the property fully when the land book shows your name — verify the final extract, not just the signing ceremony.
  • 6. Take possession measurably. Have the boundary staked out from the registered coordinates before fencing or building — the cheapest boundary dispute is the one prevented.

Where buyers get burned

The recurring failure patterns we see: paying deposits on unregistered land with "registration coming soon"; buying a share of co-owned land believing it was a defined parcel; discovering the measured area is smaller than the paid-for deed area; inheriting an unresolved overlap with the neighbour's registration; and buildings on the land that legally do not exist because they were never registered — or worse, were never permitted. Every one of these is detectable before signing, for a fraction of the deposit at stake.
