Why Romanian land needs technical due diligence, not just legal

Your lawyer checks the contracts. But in Romania, some of the most expensive land problems are technical, invisible in the deeds and visible only to a surveyor with access to the cadastral data:

  • Overlaps: the parcel's registered geometry overlaps a neighbour's — a defect that can freeze any transaction or permit until resolved, and that a paper review will never catch.
  • Real versus deed area: the parcel measures smaller than the documents claim. On a PV site, a few percent of missing area is missing rows of panels; on any purchase, it is money paid for land that does not exist.
  • Position: the land is registered, but not where everyone believes it is — misplaced parcels are a known legacy of how older registrations were made.
  • Encumbrances with physical footprints: easements, protection corridors along power lines or pipelines, and access rights that constrain what can be built where.
  • No registration at all: the "parcel" is an unregistered inheritance share — a different acquisition strategy entirely (see unregistered land).

What the due diligence survey covers

Desk phase (any site in Romania): fresh land book extracts for every parcel, reading of all three sections in plain English, verification of the registered geometry against the national geoportal and cadastral plan, overlap screening, chain-of-title sanity checks, and a written findings report with a clear verdict per parcel: clean / conditional / red flag.

Field phase (Alba, Cluj, Mureș, Sibiu, Hunedoara): control measurements of the actual boundaries and area, verification that occupation on the ground matches the registers, slope and access reality-check, and — for PV acquisitions — the terrain observations that feed buildable-capacity estimates.

For investors buying ready-to-build projects, we additionally re-verify the project's existing survey documentation: coordinate system correctness, OCPI stamps, and whether the drawings match the terrain — errors in inherited documentation surface at the worst possible moment otherwise.

When to commission it

Before signing the pre-sale agreement, or at latest before money becomes non-refundable. The survey costs a fraction of any deposit, and its findings become negotiation leverage: a measured shortfall in area or a discovered overlap is either the seller's problem to fix or a price reduction. Our fastest engagements are exactly this — an investor sends land book numbers on WhatsApp, we return the desk verdict within days, and the field verification follows on the parcels that survive it.

What do you need from us to start?

Ideally the land book numbers or extracts and the locality; even just the cadastral numbers suffice — the register is public. Send them in the WhatsApp chat and we confirm scope and fee the same day.

Can you check a site we haven't told the seller we're investigating?

The desk phase is entirely discreet — land book data is public and consulting it requires no one's consent. Field measurements on private land are arranged with access permission, typically once you are in agreed negotiations.

How is this different from the notary's checks at signing?

The notary verifies the legal chain at the moment of sale — ownership, capacity, encumbrances as registered. They do not measure anything, screen geometric overlaps, or verify that reality matches the register. Both checks are necessary; only one involves instruments.

What does the report look like, and what does it cost?

A per-parcel findings document in English: register status, geometry verdict, measured versus deed area where field work was done, encumbrances translated and assessed, and a clear recommendation per parcel. The desk phase is a small fixed-scope fee per parcel with portfolio pricing for batches; the field phase is quoted by site. Against the deposit at risk on any serious acquisition, the whole exercise is a rounding error — which is exactly why skipping it is never the economy it appears to be.
